Overview

Welcome to JacquardStudios. The terms “we”, “us” and “our” refer to JacquardStudios, the trade name of Jacquard, a sole proprietorship established in the Netherlands and registered with the Dutch Chamber of Commerce under number 42133707.

JacquardStudios operates this store and website, including all related information, content, features, tools, products and services (together, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referred to in them, describe your rights and responsibilities when you use the Services. Please read them carefully: they contain important information about your legal rights and cover matters such as disclaimers and limitations of liability.

By accessing, browsing or using the Services, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, please do not use the Services.

Nothing in these Terms limits your mandatory rights as a consumer under Dutch or European Union law. Where a provision of these Terms conflicts with such a right, the mandatory right prevails.

1. Access and Your Account

By agreeing to these Terms you confirm that you are at least of legal age in the country where you live, or that you have the consent of a parent or guardian to use the Services.

To use the Services, including browsing the store and buying our products, you may be asked to provide information such as your email address, billing address, delivery address and payment details. You confirm that the information you give us is accurate, current and complete, and that you are entitled to provide it.

You are responsible for keeping your account credentials secure and for activity that takes place under your account. You may not transfer, sell, assign or license your account to anyone else.

2. Our Products

We take care to present our garments accurately. Product photography is indicative: colours can appear differently on different screens, and small variations in shade, print placement and measurements occur naturally between individual garments, particularly on washed, dyed and made-to-order pieces. Such variations are a characteristic of the product and are not a defect.

Most of our garments are produced specifically for your order. Product availability, ranges and specifications may change at any time, and we may limit or discontinue any product without notice.

Garment measurements, where we provide them, are given in centimetres and are approximate.

3. Orders, Prices and Payment

Displaying a product in our store is an invitation to order, not a binding offer. Your order is an offer to buy. A contract is formed when we confirm your order by email or, at the latest, when we dispatch it.

All prices are shown in euro and include Dutch VAT where applicable. Shipping costs are shown separately at checkout before you pay. Prices may change at any time, but a change never affects an order we have already confirmed.

We may refuse or cancel an order, in whole or in part, where the product is unavailable, where the price or description contained an obvious error, where we suspect fraud, or where we are unable to ship to the address given. If we cancel an order you have already paid for, we refund you in full.

Payment is processed by our payment providers. We do not store your full payment card details.

By placing an order you confirm that the products are for your own use or as a gift, and not for resale.

4. Shipping and Delivery

Shipping costs, processing, tracking and customs are set out in our Shipping Policy, which forms part of these Terms.

Risk of loss or damage passes to you when you, or a person you have designated, take physical possession of the goods.

5. Returns and Cancellation

Your right to cancel, how to return an item, who bears return shipping costs and how refunds are handled are set out in our Refund and Returns Policy, which forms part of these Terms and does not limit your statutory rights.

6. Conformity and Warranty

As a consumer you are entitled to goods that conform to the contract. If a garment does not conform, you may be entitled to repair, replacement, a price reduction or a refund under Dutch and EU consumer law. We give no separate commercial guarantee beyond these statutory rights.

Normal wear, damage caused by misuse, failure to follow the care instructions supplied with the garment, or alterations made after delivery are not defects.

7. Acceptable Use

You agree not to use the Services for any unlawful purpose, and in particular not to:

• break any law or regulation, or infringe anyone's intellectual property rights;
• submit false or misleading information, or impersonate another person;
• upload or transmit viruses or any other malicious code;
• collect or track the personal information of others;
• send unsolicited commercial messages, or scrape, crawl or spider the Services;
• interfere with or circumvent the security features of the Services;
• place orders for the purpose of resale.

We may terminate your use of the Services if you breach this section.

8. Intellectual Property

All content in the Services, including the name JacquardStudios, our logos, garment designs, prints, photography, text, graphics and page layouts, is owned by us or used under licence and is protected by copyright, trade mark and other intellectual property rights.

You may view and print pages for your own personal, non-commercial use. Any other use, including reproduction, distribution, modification or commercial exploitation, requires our prior written consent.

9. Content You Submit

If you send us comments, images, reviews, suggestions or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish that material in connection with our business, without obligation to compensate you.

You confirm that the material is yours to give, that it does not infringe anyone else's rights, and that it is not unlawful, abusive or defamatory. We may edit or remove any submitted material at our discretion, but we are under no obligation to monitor it.

10. Third-Party Links and Services

The Services may contain links to websites and services operated by others. We do not control them and are not responsible for their content, accuracy, products or practices. Any dealings you have with a third party are between you and that third party.

11. Availability of the Services

We aim to keep the Services available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Services at any time, and we may carry out maintenance without notice.

12. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law, including our liability under Dutch consumer and product liability law.

Subject to the above, our total liability arising out of or in connection with an order is limited to the amount you paid for that order.

We are not liable for indirect or consequential loss, or for loss of profit, revenue or opportunity.

13. Force Majeure

We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including carrier disruption, customs delays, strikes, extreme weather, fire, epidemic, war, or failures of communications or payment networks.

14. Privacy

How we collect, use and protect your personal information is described in our Privacy Policy. Where that policy and these Terms conflict on matters of personal data, the Privacy Policy prevails.

15. Complaints and Disputes

If something has gone wrong, please contact us first at info@jacquardstudios.com with your order number. We aim to acknowledge complaints within five working days and to resolve them within fourteen days, and we will tell you if we need longer.

If we cannot resolve the matter together, you may bring the dispute before the competent court. Nothing here prevents you from bringing proceedings in the courts of the country where you live, where consumer law entitles you to do so.

16. Governing Law

These Terms are governed by the law of the Netherlands. If you are a consumer resident in another EU member state, you also enjoy the protection of any mandatory provisions of the law of that country, and these Terms do not deprive you of that protection.

17. Severability and Waiver

If any provision of these Terms is found to be unlawful or unenforceable, it will be applied to the fullest extent permitted, and the remaining provisions stay in force. If we do not enforce a right under these Terms, that is not a waiver of that right.

18. Changes to These Terms

You can view the current version of these Terms on this page at any time. We may update, change or replace any part of them by posting the revised version on our website. Changes apply to orders placed after the revised version is published; they never change the terms of an order we have already confirmed.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy and Refund and Returns Policy, form the entire agreement between you and us regarding the Services, and replace any earlier agreements or understandings.
